I have been in a joint IVA with my husband for 2 years 4 months. My husband was diagnosed with primary progressive MS 2 years ago since then he has had to stop working and is receiving ESA and PIP, sadly he will not get better and will not be able to work again. I have had to close my business to care for him and am unable to work. I receive careers allowance and income support. Our benefit income is much lower than what we earned when we took out the IVA. I had a hire purchase agreement for a van which I was allowed to continue with as it was needed for my business. As our income has drastically decreased and I have closed my business, I have had to sell the van and used the money to pay off the hire purchase. I have informed my IP but heard nothing back. We are struggling on a low income to pay our IVA and will not be able to afford the payments when they go up. My mother in law and father in law have offered to gift us £7000 as a full and final payment. Is there any chance such a low offer could be accepted
We should pay
39 payments of £128
21 payments of £318 (After my hire purchase has been completed)
Equity to be released from property £3816
Total of £15486
We have so far paid £3200
So left to pay £12286
Distributions to creditors 9p in the £

In view of the circumstances it is worth discussing with your IP and asking that the offer be put forward.
Who are you with ?

Thank you for reply. We're with Aperture. Do you much about them, do you think they would be helpful. So far when I have been in touch with them about the hire purchase and changes in our circumstances they tell me they will look into and get back to me. Ive done a new income and expenditure in march and not heard anything since.

One of Aperture's great failings is communication --- they have to be relentlessly chased to get any meaningful response.
I was with Grant Thornton -- who were Aperture before the name change -- and, when I became unable to meet my IVA payments they negotiated with my creditors to close the IVA down early and, at that time, were very good.... but I did have the help of a very sympathetic member of staff there, which helped a lot.
They are currently, seemingly under the cosh at the moment and very overworked / under resourced, so they will need constant prodding.
