I have just completed a divorce from my husband who has told me he has filed for IVA. He owes me £14,500 for debts I paid off on his behalf whilst we were married he confirmed he would re pay (in writing).
I am applying for a financial consent order, but he doesn't think this applies as he has filed for IVA and couldnt pay me back what is owed.

I would say go for the order regardless. If nothing else it would firm up your status as a creditor, allowing you to get at least a dividend. Your solicitor would be better placed to advise.
