I hope someone can help we entered an iva 5yrs ago this month but 18mnths ago circumstances changed the credit crunch hit us hard . a meeting was called of the creditors and we fully expected them to make us bankrupt, however our IP told us the decision was for us to sell our home which we did it was sold February 2010. Had a letter from the IVA consultancy two weeks ago a copy of which was sent to our creditors we now live in a rented house,a couple of days ago one of our creditors sent us a letter chasing for payment.

Can they legally do this, what can we do we have sold our home and thought everything had been finished.
Please help we have nothing else we can give them.

Hi Jules and welcome-

Please phone your IP as soon as possible to make sure that your IVA completed successfully. Did you receive a certificate of completion?

Unless your IVA failed (which you would surely know about), your creditors won't be allowed to chase you for payment.

Instead of worrying about it, it's much better to make a quick phonecall and answer your questions for good.

Take care! :)
Take care,

Hi and welcome to the forum.

Have you checked on the Insolvency Register to see if you are still registered on there?

If you have a letter of completion you can send this to the creditor in question. If not, I do suggest that you speak to your IP to see what has happened.

Has your IVA been finalised, and have you received a Certificate of Due Completion?

You need to speak to your IP about this as you should have had a letter, and if it's completed then nobody should be chasing you.

Which company did you use?
