I’m in the process of having an iva in place but in my tenancy agreement it says that the landlord can apply to the court for possession under the housing act if I have an iva. Can anyone shed any light on this please?

Many financial agreements have insolvency clauses, not they are not always enacted. Applying to the court for possession is going to cost your landlord money, whereas, in the IVA, you have carefully budgetted for everything, including the rent, so he is actually more likely to get paid !

Your agreement says he can apply for possession if you get an IVA -- does it actually say that you are obliged to tell him ? I was in rented during my IVA and never told my landlord :shock:

If there is no issue paying the rent I don’t see why everyone has to know your business ?
