I had an IVA with Mitchell and Farrar, between 2012 and 2015, I am seeking my file, as they had claimed my HSBC and Barclay card PPI for a total of £15,000. However, they did not add this to my statement and this would have cleared the IVA without a shadow of a doubt. How can I see what has happened to the money ? and whether I can claim that money back?

Hi,

It may have cleared your IVA but any PPI would have gone to your IP to be distributed to your creditors and this will have been classed as an asset. I assume your PPI was claimed after you had finished? If that was the case it wouldn't have been on your statement.

I contend that IPs should account for all monies in each IVA they deal with and that you should have access to this information. Unfortunately an IP only has to keep records for, I believe, 6 years after the case is closed, so this information might not now be available.
My opinions are merely that .. opinions based on experience. Always seek professional advice.
