Hi

Just a little one if anyone can help?

I started IVA on my own, lived on my own.....in June I got married and my hubby moved in with me however he was unemployed....

I told my IVA company and they said that was fine and just to contact them once Hubby has a job.

Hubby now has a job (albeit a very low wage)...can anyone advise me what the IP is likely to ask me for in terms of hubby's details (ie; do they have the rights to ask to see copies of his finances/wage slips)?

I know they will be expecting there to be an increased contribution from me as a result of hubby moving in but, to be honest I don't think there will be....

He is not on the mortgage and its going to stay that way - I have the house named with my father therefore hubby agreed mortgage nothing to do with him and he wouldn't be entitled to half of it... he gives me £ towards the extra food/toileteries/home things I need to buy because he lives there and then the rest of his money he has a son which he pays for, he has a car to run and he has bills to pay (mobile phone etc...) and as he has been out of work for a while he has had to borrow money to tide him over so he has to sort out repaying this...leaving nothing extra for him to give me towards the house/bills....

I am completely fine with this as I knew his circumstances when he moved in but do you think there is likely to be any problem with my IP...

I know the constant message on here has been get on with your life and loves and don't let the IVA stop you...so, I have but now I'm hoping it doesn't bite me in the bum by putting me in a worst position financially and worried what could happen if the IP does demand more money...

Any advice/views would be greatly appreciated.

Tell your IP exactly what you have told us and I am sure that everything will be ok for you, if there is no extra available then there is no extra available. I am sure he or she would probably frown at any proposed reduction, but as long as you are not penalising creditors then you should be ok.

As long as this is not affecting your IVA payments, then I cannot see that it will be a problem for anyone.

Thanks so much for your response.

Definitely won't be any reduction in the payments I make to my IP - I've made sure of that...just wanted to check what the status quo is with hubby, and you've helped me greatly so really appreciate that.

Just a bit of a query if anyone can help me????

I spoke to Payplan today who said I need to do a new I & E Statement and they will assume that hubby will pay half towards bills...

This isn't the case though...anyone know where I stand and how much Payplan can push for this to happen?

He has Child Support, a Car and arrears to pay so all he can afford to give me is the extra it costs for food shopping now he lives with me...he can't actually afford to give me anything toward the household bills.

We separated because of my debt and got back together on the agreement that it wouldn't affect us and he wouldn't be penalised for it.

If Payplan insist on hubby paying half toward my bills he will go ape. I don't want to lose him over this but am worried this could cause a massive problem between us.

Any advice greatly appreciated?

They can't push your partner at all, but they can insist on an income and expenditure summary detailing his contribution towards the household. And they should not assume that he can pay half of the bills, because if he doesn't have the income to do this then he won't be able to.

If you provide them with a detailed statement of your combibed income and outgoings, they will surely be able to see this for themselves?

Thanks again - you always give great advice and calm me down!

So, if I pull together a joint I & E I will include both income's and will they warrant hubby's car loan as a genuine expense or can they disregard unsececured payments?

Also, will they allow for the payments to Family & Friends he is making as a result of being out of work?

And CSA?

I will sit down and look at a joint I & E now and hopefully I can reflect what I was saying earlier in the post.

It is a genuine expense - of his, so you cannot be seen to be supplementing the repayment of that loan. When you say he is paying sums to friends and family - were these short-term loans as well? If so, then yes they can also be declared - and the CSA payments he is making.

You're a complete star!! I've just pulled a spreadsheet together which compares my original I & E approved for my IVA compared to the genuine situation now.

Really appreciate if you get chance to look at this, but not a problem if not - thanks again for your help!!
