I am in the process of applying for an IVA. My 3 bank statements i have to produce are a mixture of my wages and my partners money. she was left a sum of money by her father and is totally her money. Is it adviseable that i get my own bank or is it safe to send off my statements in the hope the IVA company don`t use it as an asset. My concern is that they will use her money and pay off some of what i owe and she will lose her money.

Hi Steve,

That money is hers and nothing to with your finances. I am assuming it is just yourself applying for the IVA?

I agree with Ray. I presume that if necessary your partner will be able to prove that the money is hers?

Explain to your IP that your wages have been paid into your partner's bank account and you will now be opening one in your own name. You probably have an overdrawn account with your previous bank which would explain why you had to do this and any reasonable IP would understand.

Your partner has no obligation to supply her bank statements although the IP will want to see that she pays her fair share of the bills.
