I have a builder that owes me money for about 12 - 18 months. He has paid some back over the last year but stills owes me around £1200.00. I have found out that he has entered into an iva about 6 - 9 months ago and has not included me and some others in it. Is this ilegal and what should be my next course of action be? Thanks

Hi,

All unsecured debts should be included in an IVA.

If you know who his IP is I would give them a ring to explain that your debt has not been included.

This could ne judged as a material irregularity which could void the IVA. Suggest you have a chat with the IP concerned to see why your debt was excluded.
