I have a IVA which i stopped paying around 13 months ago (was £1650 per month) i lost my job, so after paying off around £22,000 debt i still have around £80,000. The IVA company isnt bothering me, but what is going to happen when my 5 years is up in October 2011 ?

Also my wife has left me, and she coninutes to 'dip' into our one account (RBS) taking over £500 last month - when i try to apply for a new bank account it comes up that i am bankrupt so cant open any accounts - so i cant move my bank account - stuck between rock and hard place - so any advice welcome on the above issues, thanks

Hi,

If you have not paid for that length of time I am surprised your IVA has not failed. You need to speak to the company, and also check on the Insolvency Register to see if you are still listed on there as being in an IVA.

As regards your bank account, I would open a new account with someone like the Co-op and try and have your name taken off the joint account.

Just checked register and it states i have an active IVA all be it says 'see footnote' but there isnt one !

I can freeze our joint mortgage / current account once i set up a new account - will look into the co-op to see if they can help - thanks
