i have a mortgage shortfall with my ex partner and are at the point where the solicitors want me and my ex to complete a finance sheet. i have been told by my ex that he is not going to cooperate (its his fault that we got this bad into debt in the first place!) and that if he doesnt cooperate that they will come after me for all the debt which in total is nearly £35,000. I would like to know what to do to make sure that if i do make payments that i will just be paying my half and not all of it

Hi there and welcome to the forum

The debt is joint and several, so the mortgage company ought to pursue you both for the shortfall. You both actually owe the full amount, and I am afraid there is no such thing as both owing half of this type of debt.

The best thing to do would be to negotiate directly with the mortgagee an affordable monthly repayment, and hope that they will pursue your ex-partner vigorously. Is this your only debt?

And do remember that you can declare yourself bankrupt, and leave your ex-partner dealing with the mortgagee directly.
