IVA co. took £4000.00 paid in error to me

Child tax credit paid £4000.00 into my bank account in error. Then it was taken out of my account. The Child Tax Credit now want it back. I have just found out that my IVA practitoners took it, without my knowledge. What is my legal position on this.

Hi Christine and welcome to the forum., May I ask how your IP took the money without your knowledge? Did they know it had been deposited within your bank? x
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

I'm surprised they knew about it as well. My IP company would not take any money from my account without my knowledge. I doubt they would have known about it.

I suggest that you speak to your IP about this.

To be able to take money from an account in the manner that you describe needs a direct debit. Most IP firms I know of are paid by standing order and not direct debit. A standing order does not allow the payee to either access the account, or change the amount or date of payment.

This doesn't look right to me therefore, so I suggest that you investigate this further with your bank first of all, as they will be able to provide all the relevant details of such transactions, and then after that with your IP.
