If you were a Borough Councillor and were thinking of going down the IVA route would you have to declare it or would you have to cease as a Councillor ?

Hi David and welcome to the forum.

I have no idea on this, but would think you would be ok.

Hopefully one of the experts will be along with further advice.

Not 100% sure though.

I can't say it is a question that I have ever been asked directly before, but this thread should help http://www.iva.co.uk/forum/topic.asp?TO ... councillor

I am a local town councillor and I have not had to declare this - however my role is completely volunatary with NO expenses even for mileage - there are some guidelines in the Code of Conduct and I think Bankruptcy is mentioned. Borough councils tend to pay expenses to their Councillors so this may be different

No - I have several clients who hold such positions. In one case their position was challenged by a hostile political opponent who discovered their details on the Insolvency Register - but they were thankfully thwarted in their efforts.
