I’ve been accepted for a iva last week but noticed they have missed a creditor creation finance which is DFS sofa. I got these sofas 2 weeks before my Iva was accepted and totalled £1,077 I’ve rang up creditfix and told them and they said they will just be added onto the Iva and will inform them and to cancel the direct debit with them.
Thing is I haven’t even made one payment to DFS yet? Surely DFS are going to be pi**ed off and demand the sofas back or not accept the Iva?
Will my iva be in trouble now because of this?
The women over the phone said she will just add it on once I’ve sent the contract to her (already have)
I feel really bad doing this, and when I wanted to cancel my sofas I couldn’t as was out for delivery.
I couldn’t not tell creditfix as we all know credit isn’t allowed and I don’t want to lie either and the payment be through direct debit so they would of seen on my yearly review.
I’m just worried now what’s gonna happen with my Iva and is DFS gonna be on my back now?

They cannot do anything about the IVA and will have to accept it. It could well be that DFS will want the furniture back but I have no idea how they work.

If/when it gets added on I’m guessing they will either try call or write to me regarding this? I don’t want to cancel the direct debit if I have no proof from CF it’s been included.
I feel like I’m robbing DFS because of this. Wouldn’t it cost them more to come and collect it as they can’t ask for me to pay for it as I’m in a iva. Of course I understand I have to pay them. Just worried me now as wanting CF to give me definite yes it’s included and be extremely embarrassed if they wish to take the sofa back (I understand if they did) yes it’s in my name but partner was going to pay for it. Which makes no difference I know as in my name.

As Kallis says, as long as the 'new' debt doesn't increase your total debt by more then 10% the IP is allowed to add it in as a genuine mistake. However, DFS might well want the sofas back, though I don't know how this would work with the IVA as then there would be no 'new' debt !!

My debt total was £18.040 and DFS debt was £1,077.
If they ask for the sofas back then surely I shouldn’t pay them? As they have the goods back and I wouldn’t need to pay them? Then have to fund somehow for a new sofa.
I’m awaiting for CF to send me some proof it’s been added as I don’t want to cancel it then cause myself any problems if there not aware or been added.

I have no idea how this will work. If they take them back they would not be added but no idea how you would go about funding a new sofa.

Funding a new sofa I may have to ask family to donate. I know if needs be a family member is having thoughts of buying a new one so maybe be able to have their old for free. It comes to it,
Just hope creditfix let me know so I’m aware. As I’ve told them I don’t want to cancel the direct debit without proof it’s included

If it's not included it will be classed as extra credit which you are not allowed.

I am aware of that, that’s why I hope now I’ve sent everything they need from me about it they will add it on. Because I don’t want any issues from this. I’ve done my part she said over the phone she will contact them as it’s going to be added but how do I know that? Will they send me proof as I have asked for that so I don’t worry. As my other creditors obviously I have the paperwork to prove they are added and there fine.

Finally after calling numerous of times and talking to different people, I spoke to a member of staff and he looked over and said it hadn’t been added so he did it straight away for me took all the details which I was asked before. He’s explained will take a while to be added on so call back next week to check it has been for a update. But for the second don’t cancel the direct debit for the moment till I’m fully covered with the Iva on them. So will see what happens next week regarding this.

It was last Wednesday when I called creditfix regarding the missing creditor as stated above, do you think if I call them today and ask if it’s been added it might have been? Or do they need some more time? Unsure how long this takes for them. I haven’t cancelled the direct debit as advised by creditfix not to do it yet but the first payment is due this week.

I would ring them mercilessly -- one of their biggest faults is communication. Keep on their backs!
