I've just found out my ex partner, who has an IVA must have lied on his IVA application. It says they live at our jointly owned house, while in fact they moved out 6 months before the IVA started and was living with parents.
Should this not have been picked up in background checks before the IVA was approved? Or are no checks carried out to confirm the information provided by someone applying for an IVA?
Much of an IVA is based on trust as regards background information, the main thrust of checks being on debt levels and on income levels.
The fact that he lives with his parents might affect his income and expenditure statement, in as much as he might have declared half the mortgage payment as expenditure when he is not paying it --- unless, of course, he is still contributing.
You could, if you wish, have a chat with his insolvency practitioner, but, putting his IVA at risk might then put the house at risk should his creditors sue for bankruptcy instead, unless ownership has already been settled by the courts.
