My husband maybe getting a pay cheque for an equal pay claim, this is going back pre-IVA. Would he still have to declare this and if so does the amount go off his IVA balance or is it just seen as an extra payment

Hi Joanne and welcome to the Forum.
Assuming your husband is in an IVA in my opinion this would constitute a windfall and would be payable to the IVA. Had your husband received his proper entitlement he would not have needed credit so much so it is only fair to return this money to creditors.

Tell him to speak to his own IP who may have a different opinion. If the amount is less than £500 he may be able to keep it even if it is a windfall.
