My soon to be ex husband took a IVA and added my name with out concent I have been fighting for months to have it removed now UK trans union are stating that the company the Iva is with needs to request it to be removed and the company is saying they won’t do that. ThIVA on my credit file should never have been placed as it was done without my concent and according to the paper work I was sent the IVA states the nominee fee was accepted but the creditor rejected it on round of material irregularities.
What can I do know

An IVA is an individual arrangement between debtor and creditors. How, exactly, is your name on the paperwork ? Or has the IP, somehow, arranged an IVA for you as well, without your consent ? Often couples in debt can have an IVA each, sometimes interlocking, so to treat them as one.

Have you checked the Insolvency Register to see if you have an IVA registered in your name ? https://www.insolvencydirect.bis.gov.uk/eiir/

If the IVA company refuses to assist you need to make a formal complaint, direct to the IP, and you can then follow this up with a complaint to their regulatory body --- often the threat of this makes them inclined to listen more!
