My stepfather is about to enter an IVA

My stepfather is about to enter an IVA. He currently has a life interest in my mothers property (now deceased) and his name is on the deeds - however the house is in trust until he dies when I will inherit it. Can his creditors come after the equity in the house towards the end of the IVA?

Hi Grant and welcome to the forums!

Get him to carefully check the terms in the IVA and talk to his IP. If he cannot release the equity then this property should be excluded.

Hi Grant, if you are indeed the same poster as yesterday's thread, then I agree with Melanie and advise you to seek legal advice. There appear to be a lot of angles on this, and it would be much better discussed with a law professional than on an online forum.

His life interest in the property may well be showing on the deeds, but this does not necessarily give him a proprietory right nor beneficial interest in the property. I would doubt from the information you have already provided that creditors could overturn the trust your Mum left you with, however specialist legal advice should be sought at an early stage if you feel there is some risk.

Why not call up your stepfather's IP to see what views they have?
