A tenant of mine who is on an IVA has got int 3 months arrears on his rent.
What action should I take. I am ready to start court proceedings for Eviction,but I have to wait untill his notice period has expired
His rent should be ringfencrented in his expenses to allow this to be paid. This is a new debt and is not covered by the IVA, so normal recovery / eviction procedures will apply.
It could be worth sitting down with him to see if his IP will allow a payment break in the IVA payments to catch up the arrears on the rent. He could have just hit a rough patch and be drowning.
This, of course, depends on how co-operative he is generally.
