Hi, my wife and i have IVA's taken out at the same time. We are now seperated and i want to go Bankrupt.Will my wife have to as well? or can she carry on with the IVA.We make one joint payment. Thanks

Hi Adrian and welcome to the forum.

You will need to speak to your IP. You can seperate your IVAs and your wife doesn't have to go bankrupt as long as she can maintain her IVA.

Is there a property to be considered?

If there is no longer a surplus as a result of running two properties, creditors may accpet what has been paid to date as full and final settlement. As Jan says, speak to your IP who will have the full facts of your case.

Hi thanks for the swift reply.There is a house with morgage and secured loan so prob in negative equity.i live in the house but quit happy to see it go.
