My wife’s ex husband wanted £20,000 from there property.
When he left 8years ago the house was in negative equity.
He paid no monies towards the house or the two loans he had secured on the property. We have paid these off now and towards the mortgage sub total in excess of £56,000.
We got a solicitor to help us he advised us to offer him £10,000, to which he accepted.
We g
Went to court to get all this legal and above board.
This was completed last year in November,
We knew he had debts so the order said he was to pay off his debts with his equity.
We where just about to complete the mortgage transfer when it was stopped by his IVA company Aperture. They say there is an order against the house which my wife did not know about or see any paperwork telling of this.
We are now in limbo as we want to move on but can’t due to this mess that her ex husband as left.
You need to go back to your solicitor. The IVA provider would have put a restriction (not order) on the property which she should have signed to agree to. Maybe he forged the signature, I don't know. Negotiate with Aperture to see if they will accept that £10k into the IVA in return for them releasing the property from the arrangement.
My opinions are merely that .. opinions based on experience. Always seek professional advice.
