hello all, I am hoping someone will have been through this like me and can give me some advice, as you may or not have read earlier I am having problems with Tesco Credit Card, tonight I got called by them and stupidly I spoke to them, where as the young lady on the phone was pleasant, she had no clue or idea of an IVA what it meant or implicated.Despite Payplan assuring me they have dealt with this for us I am 3 months in and no further down the tesco credit card road, still they swear blind they have no record of an IVA. I have given my case officers details and and phone numbers, numerous times, but nothing and they SO want their money back. I have been passed to Trident Debt recovery now.
PLEASE help me, I am really worried now and are doubting whether payplan are actually doing anything and just taking my money. I am so scared my IVA will fail after acutally starting to have a life again in the last three months.
I will contact payplan tomorrow and send them the scanned letter.

Hi, I know it's easy for me to say but they are bound by the terms of the IVA if Tesco credit card was included within this.

Tesco nor Trident can touch you and they cannot make your IVA fail.

Have you checked you're on the Insolvency register, assuming you are refer them to this as it's a public document, we had to do this very sternly with Mercers (Barclaycard) and eventually their calls did stop.

Do scan your letter for Payplan and explain the stress these calls are causing you. Hope you're ok now? xx
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Thanks yes Tesco Credit were included,but i don't think checking the report again ( again and again and again and again) that they voted, but150% were on the proposals. which makes it frustrating,I had a huge loan with them too, nothing from them, or any other creditor. I will try and ensure this is out to bed tomorrow. I tend to live in everything bad will happen world, and usually it does. Probably won't sleep well tonight, as I am sure the IVA will fail have worked myself up into a right tiz

So long as Tesco's was included in your IVA they cannot touch as they are bound by it whether they like it or not, they certainly cannot fail your IVA.

It does take a few months for the info to filter thru the systems and if they haven't got the info that's their problem not yours, usually the phone calls people receive are from the companies call centers and they are the last to find out.

They can pass or sell to debt on to whom they choose but whoever it is they are also bound by the terms of your IVA, get in touch with Payplan and tell them the hassle you are getting and I'm sure that they will sort this mess out for you.

Hi, I know you probably replied to one of my questions re: Santander, have been having the same problem with them to be honest, been in the IVA for 3 months, all creditors are included but got 3 letters last week in 3 days (what a waste of postage, trees and admin time) I had not heard anything from them for a good few weeks and though "oh, the penny has finally dropped" but they are clinging on for dear life so it seems. As Lesley has said, you have the piece of paper with them as a creditor, whether they voted against, for or did not vote at all, the IVA has been accepted and they, as well as you are legally bound by it and cannot do anything about it. I have written to my problem company stating this last week, as well as writing to my IP with the information so if I get any more hassle from them I feel quite within my rights to suggest if they do not stop I will report them to the FSA or whatever Ombudsmen they are ruled by. So in short, do not stress.

Thank you endsmeet, I asked Payplan to confirm I was protected from Tesco, and they emailed ages ago to assure me I was. Lets hope they will deal with this quickly tomorrow for me.

Payplan were really good to me when i kept getting threatening letters from Egg, i only had a £100 debt with them and they voted against my IVA. I received a letter saying they were going to send someone to my house so i told Payplan, my case officer asked for the contact number on the letter and then i sent the letter in the post. The next letter i had from Egg acknowledged my IVA and i haven't had another since. Have faith in Payplan but ensure you tell them how much you're worrying about this.

I'm sure that they will, I was still getting calls from LTSB about a month or so after my IVA had started and a quick call from Payplan stopped it all and I even got a written apology, I'm sure that if you ring them and tell them what Tesco's are doing to you that they will do the same...

As long as they are included in the IVA then you have absolutely no worries. Just put the phone down, refuse to confirm your security details so they can't carry on.

They can do nothing to you at all.

Is there any chance that you could change your phone number?

Thanks everyone, what if they are not included even though i can see them on the proposals or something has gone wrong ? What can have gone wrong, when all other 12 creditors are ok. I will email Payplan tomorrow morning I am sure I am over reacting.

If they are on the proposal then they are included.

Please don't worry, their threats are empty ones.

We had trouble with Tesco for a while but I would tell them the name and phone number of my IVA provider and nomore. When they kept on with the calls I told them that I thought it was harassment and that if they persisted I would get the police involved. The calls stopped.

Please do not worry about it, they are included in your IVA and that is all there is to it, they cannot do anything at all so try not to stress about it, I know it is not easy at times but just try and forget about it and let your IP deal with it.
