I had an IVA from 2009 - 2014. Unfortunately I did not keep paperwork after that. I know the IVA company sold this and then that company stopped existing. My error was that I was taken in by PPI Company letter offering to get tax back. I was due payments back from bank who now say that they have offset what I should have been paid against the debt that was left despite me thinking it was legal IVA & rubber stamped by a County Court. How can they override this? They now say I still owe them over 1000 GBP .
They should not offset after an IVA, one bank in particular often does this, knowing that you are unlikely to argue. However, the PPI refund might not be yours anyway. In theory the refund belongs to the IVA, even after completion, and is due to your creditors. It is possible that the trust created by the IVA still exists ... can you remember the name of the IP involved ?
My opinions are merely that .. opinions based on experience. Always seek professional advice.
IVA Completed 23rd July 2013 .... C.C. 10th January 2014
