Good evening all,
I finished my IVA last September, got my certificate in April and started a PPI claim afterwards.
During my IVA they got PPI payments from different sources. I had to inform them of the firms to deal with, which I did.
Today I received a letter saying I was owed an amount to be refunded but it has been sent to McCambridgeDuffy. The thing is the account was closed 11 yrs before I went into the IVA.
My question is; are they entitled to this and are they going to pay the company their fee for getting it.
Yes, they are entitled to it, if they wish to deal with it. Some IP's will declare that they have no interest, in which case the money will be returned to you.
Regarding fees --- if the claims company are sending the refund to McCD they will have deducted their fee. If it is going direct from the creditor the claims company will come to you for the fees. In some cases the IP involved has agreed to reimburse these fees, so you don't lose out. They are not ob;iged to, but, from experience, McCD do play fair, so I am guessing they will sort the fees out.
My opinions are merely that .. opinions based on experience. Always seek professional advice.
IVA Completed 23rd July 2013 .... C.C. 10th January 2014
Got the answer today...
If you have paid 100p to the pound the PPI refund is yours to keep, if not the IVA keeps taking until it is.
As for fees, as you said Foggy, McCD told me to tell them to invoice them.
Sometimes the original IP isn't interested, especially for that amount.
