our iva was completed after 2 years, and we were debt free after 6 years,we had Barclaycard on our debtors list when we took out the iva,now our iva has finished we have found that we had ppi on Barclaycard can we successfully get compensated without them retaining any of the funds.
Unfortunately the money will belong to your creditors as it is an asset. If you managed to pay off your debts in full plus fees when your IVA finished, you should be able to retain some of the money.
Sharing from experiences of dealing with debt
The greatness of a man is not in how much wealth he acquires, but in his integrity and his ability to affect those around him positively.

It is becoming increasingly common for creditors to withold refunds and use the money to offset the previous debt .... they are not supposed to do this, but, as far as I am aware, have remained unchallenged. So they might not send anything to you anyway.
As Kallis has said, as the law currently stands, PPI refunds and the like still belong to former creditors under the IVA trust and are payable to the former IP. The creditor making the refund may well want to see a declaration of non-interest from the IP before making payment to you --- which may not be forthcoming.
Be aware that, if you use a claims company, the fees will have to come out of your pockets in the vent that the creditor offsets or witholds funds, or if they pay them direct to your IP.
My opinions are merely that .. opinions based on experience. Always seek professional advice.
