We had an IVA closure in 2012 with everything eventually cleared off the registers and Credit files. Then after allowing the IVA supervisors to claim PPI back they wrote to the creditors explaining that we were in an IVA.
This put our Credit file back into "trouble" and our creditors made us repay loans and CCs back, as they thought we were in an IVA still.
It then had a knock on effect to my security clearance and I was suspended from my job.
Now everything is calmed down, we get another letter as our supervisor has a new solicitor and they want to try again.
I feel that if we give consent, the same thing is going to happen and I will get suspended from my job again.
Do we have to give consent, or can we apply on their behalf.
I am guessing that what you are refrring to is a letter from FDM via Aperture to re-investigate PPI refunds.
What you describe happened the last time makes no sense and would seem to have been a massive misunderstanding on the part of your former creditors and shouldn't happen again ( that said, it shouldn't have hapened the first time.
As for complusion to sign this latest request, no-one knows A) What pressure the IP can bring to bear if you refuse and B) Whether they would be willing to pursue the request through the courts for a definitive answer. Added to this they only have a few weeks to lodge claims anyway, so would run out of time with any delay.
I gather that many have refused and, so far, no-one has come back to the forum here with any outcome.
