My IVA was transferred over to EbeneGate earlier this year. My 3rd year review took place a month late in Novemeber. They increased my payments by £93. I compained to EG and they sent me an expenditure form and asked for 3 wage slips a p60 and 3 bank satements. They had misplaced the last email that I sent with this info attached. They are now saying that my payments will increase by £60 instead of £93. I have asked how they have come to that conclusion since last review I am now earning £100. My last review my payments stayed the same.
I asked how I can make a complaint and they said I would have to supply shop receipts and more expenditure detail if I complain.
They have said that I have £500 disposable income which I know I do not. I cant seem to get them to understand that how ever they are calculating is wrong. What can I do I am my witsend with EG.

Send an email direct to your IP, requesting a detailed written explanation of the calculations, if this is not forthcoming you can complain to your IPs regulatory body via the Government Gateway here: https://www.gov.uk/complain-about-insol ... actitioner

Certainly don't pay the extra per month until you have a written explanation of how they calculated this increase, and if not forth coming follow the link Foggy has provided to complain formally.

After sending a formal complaint letter to my IP and requesting a written break down of the annual review. Ebenegate response was sending me another expenditure form to fill in. This will be the forth one that I have sent to them. What should I do next because this company seems intent on squeezing more money out of me.

Give your IP a chance to respond, rather than Ebenegate (who are basically an offshore administration firm). You could prod him / her by asking for details of his regulatory body in order to pursue the complaint.

Hi Foggy I have just received and letter from my IP. Nothing in the letter about my complaint, just a copy of my annual report. Can I refuse to pay an unjustified increase in my monthly payments? Will this make my IVA fail?

No, you cannot refuse to pay outright. Three missed payments (or reduced payments) could see the IVA fail. IVA providers have us over a barrel here. You can argue the case and, ultimately, complain to regulatory bodies (who will only slap the wrist or fine the IP directly, rather than actually intervene).
