If you wish to complain - first of all you should find out who deals with complaints in that firm - the IP's firm and not the firm who introduced you to him, and send written details of the areas of concern. The IP must be given the opportunity to deal with the issues you have raised, and to give you a proper response from his perspective.


If this does not work - then you can complain to the IP's own regulatory body - the ACCA.

Ian Holland is a director of MD&C so there is definitely a tie up between the two.

Like you Melanie, I find this tale strange and find it difficult to understand how such advice could be given.

I think that there are grounds for a late admission of the claim, however, particularly since NR would have received notice in the other IVA.

Thanks for the advice. Ill call my IP this week and try and clarify a few things. See if i can get any further forward. Ill let you all know the outcome.

Hi. Last night i drafted a letter to my IP demanding clarification on these issues, and was going to send it tomorrow morning. However i have come home from work tonight to a message on my answering machine from my IVA firm asking me to call back as they have been speaking with Northern Rock about the loan mortgage issue and also about a variation. I find this all a coincedence that i have had no phones calls or anything from them for a long while, and then strangley 24hours after posting my issues on here i have had a phone call!! Do anyone else find this strange? Obviously im happy they have eventually picked up the phone to ring, but still cant get over this huge coincedence! Ill be calling them back first thing tomorrow as they were closed tonight, so ill let you know the outcome!!

Don't worry about whether it is strange or not - if your IP is now willing to sort this issue out, make hay while the sun shines!

Ok i spoke to my IVA company yesterday and they say that Northern Rock loan should have been on both of our IVAs like you stated, and now Northern Rock might be taking ME to court about it!!!! This isnt my fault, the loan was in joint names, we provided all the relevant details, its their mistake so why am i potetially being taken to court? The IVA firm said this is 'unlikely'. Also said they are trying to now put it on both of our IVAs? Im going to phone them back today as im so confused.

OK - so they made a mistake, but so did you when you signed your proposals which presumably did not include the creditor. At the end of the day the onus is on you to make sure that the documents which had been prepared for you were accurate. Did you check the documents before you signed them?

I am sure that Northern Rock will agree to join in your IVA, and your IP will need to address how to deal with any dividend issues which may arise from the inclusion of an additional creditor.
