Hi,

Out of the blue I’m starting to get calls from a company called Red Castle Recoveries at work. I refuse to answer their security questions and they keep slamming the phone down on me [:D] Assuming they are trying to contact me over a debt included in my IVA how much trouble can I get them in? ( I’ve dug out my old files and quadrupled checked everything – no loose ends whatsoever)

If you know there full details - get your IP to write a email to them about you situation.
If this fails you can do this yourself - stating all communication via your IVA company, failure to do this breeches OFT guidelins in debt recovery(failure to communicate with third party) - in which case report them directly to the OFT.

Thanks Ginger,

I've got a suspicion on which debt it is. The smallest debt of the entire IVA was a Dell financial one that went through a debt collection merry-go-round [:)]

I'll write a letter to DFD. I need to poke DFD with a stick anyway as I'm due to finish in November and have heard nothing from them in a while.

Quicker and cheaper is to email them (use to automatic receipt setting)- As i said if no luck with this, write directly to the OFT. Regardless they are bound to the IVA.

I woulc certainly threaten to report them. I would also be less than polite with them now on the phone.

Tigger - I shall wait for them to contact me then! I am still getting letters from Creation regarding a Dell finance agreement. I have sent their latest threatening letter to my IP today but they are the only ones now that are bothering us. Spoke to them yesterday and they say they didn't know we were in an IVA and they will be referring to debt collectors in the next 7 days.
I don't really care what they do but it would be nice to now get on with the next 5 years without having to keep ringing people to remind them to p**s off!!

Hi Kazza,

Dell (via CIT Group) were by far the dumbest creditor in my IVA. As my IP cleared up the situation with one debt collector, they'd launch another one after me [:(!]

Sounds awful, I do feel that constantly calling you at work is inappropriate and harassment, I would report them for just doing that!

Glad you're sorted tigger - hopefully things will continue smoothly for the remainder of the term.
