Repairing credit file

Hi - I entered into an IVA with my ex Husband in September 2009. The marriage failed and we separated in December 2012. No further payments were made after this time due to Redundancy/change in circumstances. I did inform the IVA company Debt Free Direct of the situation and gave a forwarding address. I have received no communication from either Debt Free Direct or any Creditors since this time. I am in process of trying to repair my Credit File/Rating and contacted Aperture (taken over Debt Free Direct cases) who provided me with a copy of an Annual Report & Notice of Non Compliance dated 20th November 2015 stating that the IVA's had now failed an they were providing a Certificate of Termination. It also states it was not necessary to petition for the Debtors Bankruptcy. There is nothing showing on the IVA Register and nothing showing any outstanding debts from any of my Creditors??? I have asked Aperture for a copy of all payments to the Creditors and when the last payments were made - they have again provided me with this but it is all very confusing. Is there anyone out there who can assist me?

Have you checked all three credit reference agencies ? Remember to check on previous addresses as well as the current ones.
The IVA's would have come off the Insolvency Register having failed. All defaults would have disappeared from credit agencies in 2015, if they were correctly dated.
Creditors are still able to pursue you to enforce repayment up until the debts become statute barred ( 6 years after they were last acknowledged by you ---- which was probably when IVA failed in 2015).

Hi yes I have checked all 3 agencies with all previous and current address and definitely nothing. Thought that might be the case but I wanted to check. I have noticed that no payments were made to the Creditors from June 2012 until August 2014 so over 2 years. The final payments were made in August 2014 which I thought strange? Thanks Joanne

The first payments go to cover the Nominees fees, as agreed with creditors in the Chairman's Report. This is sometimes limited to, say, the first 6 months payments, but not always, depending on the various figures involved --- but it is usual for creditors to get nothing in the early months.

I'd be happy to look at the documents they sent you and talk you through it.

Even though the IVA failed that did not mean that had to necessarily make you Bankrupt.

Odd that all of the debts seem to have dropped off the credit report - perhaps they were all written off and now the 6 years has passed.
