When I set up my iva 18months ago I was working. Since then I have had an accident that leaves me unable to work. The only personal income I have coming in is my existing DLA. My iva costs 340.00 per month. My DLA provides me with 390.00 every 4 weeks. My husband receives 53.60 per week carers allowance and 28.00 per week industrial injuries pension. We receive 179.00 per fortnight IS. Do you think it is right that they are taking all but £50.00 of my DLA. I have long term MS and need my DLA.

Hi and welcome to the forum.
Sorry to hear you can no longer work. I too have MS.
Do you have any assets that would be at risk with Bankruptcy procceedings?
Perhaps now that may be an option which would allow you to move on with your life without the added stress.

I suppose the only asset I've got is the dynamic pin I've had put in my hip. Don't suppose they'd want that do you ha,ha,[:)] Hope your MS is treating you well mine is just having a moment but hey lets stay positive.

Its bearable at the moment.....The neuralgia on the other hand......
I really cant see anyone wanting your pin so maybe give it a bit more thought then you can get on with the rest of your life without worrying.
Unfortunately DLA is classed as income when in an IVA and unless your costs incurred by your illness offset it then im afraid you do have to hand it over to your creditors.
Im not entirely sure how its treated in Bankruptcy but i do know you would be left with more disposable income.
