Aperture are still floundering after recent case acquisitions. I doubt they are trying to shift blame, but are just in a mess. Keep copies of all correspondence and keep pressing them.

Hmmm ... it should have been disclosed at the start of the IVA and the possibility of having to repay built into the agreement. I don't know the impact this will have now and can only advise a chat with your IP.

Cobby if you are in an interlocking IVA then the total joint equity could be less than £10k (5k) each for the equity clause to kick in. How much equity is there and is this based on a valuaiton? We are unable to re-mortgage anyway so surely the equity part of it doesnt come into it now?? surely it ...

You do not have to take out the secured loan, but they often work out better in the long run than a remortgage at high rates. Don't forget with a remortgage, you are not just remortgaing for £45k --- you are remortgaging the whole of yours and her equity, so the whole new mortgage on the property wi...

About £45k -- enough to trigger teh release clause. However, it is possible that A2Dominion will have a condition to their ownership that you are not allowed to remortgage so the 12 month extension would have to be applied.

As long as you are not with Payplan your income and changes in your expenditure will no longer be of any concern to your partner's IP. Most firms only use the solvent partner's I&E to calculate their fair share of expenses at the start. As regards the expenses you have omitted you will probably ...

I am afraid that this is a common theme when cases have been transferred from one firm to another -- partly down to, as you say, under resourcing the transfer, but also down to unforseen matters such as the state of the transferred files and compatability issues with software (old paper files might ...
