Topic: Can I still get a student loan?

Not an easy one to answer. Normally student loans are agreed to by the IP ( You do need their permission for new debt over £500) on the basis that repayment will not be due until the earnings trigger is breached -- which is likely to be well after the IVA has finished. However, in your case, from wh...

hey, thanks for the advice/help. I just thought they would go through income/expenditure on a annual basis? bearing in mind that we sent everything they requested, to then all of a sudden after 6 years they say we have earned to much and need to pay it back, which we are doing but just don't know w...

He can refuse to divulge his income, in which case they will assume he pays half of the expenses --- which is the best you will get unless his income is way below yours anyway. Be aware that extra income from you should be being shared with your creditors, so you only get to keep around half. I am a...

You haven't had the IVA or procedure explained to you very well at all. You agree an amount to pay towards your debts and the creditors pay the fees, from those payments, to the IP. So, for you, there are no fees on top of your agreed payments. If you cancel the IVA you will not get back any money a...

They appear to have covered themselves, but I would scomplain anyway as they are simply taking far too long to carry out a relatively simple task. On the plus side you could, if you wished, add in a clause that the lump sum amount will reduce by payments made since you tabled the offer. However, thi...

It is not for the IP to tell you when you are earning extra income --- you should be aware of this yourselves and know that you have to pay extra over to the IVA. If they are extending the IVA in order for you to make up the arrears this would indicate that they are not looking to fail the IVA (whic...

No -- you cannot incur more debt. Most arrangements alow for up to £500 credit to be taken without the IPs permission -- however, this is intended to cover things like credit meters on utilities and installment covered car insurance and the like ... not catalogues.

The new debt owner will be bound by the IVA exactly as the original creditor was. You need not correspond with them apart from giving them details of your IP and giving the IP their details, so the two can correspond and sort it out.

I would not change anything until I speak to Aperture -- on a call of my own making first.

This is the first I have heard of this and you are right to be sceptical.

The variation meeting has to be called within 21 days of your IP getting all the information they require --- NOT from the date of your request. My guess is that they have thrown this into the pot to give themselves more time. If they had genuinely wanted it they would have asked for it before now (...

Your broker is wrong and I would be worried that your broker isn't clear in his knowledge of IVA's --- the discharge date is a BR term. What they are all talking about is the completion date (you complete an IVA, not get discharged). This will be when the IP issues a Notice of full implimentation --...

Make a formal complaint, direct to the IP, mentioning that you will be escalating the matter to their regulators via the Government Gateway.
