If he is being allowed to 'with hold' family debts until the IVA is complete then you need to make a formal complaint as he should never be allowed to have preferential agreements in place just because they are family. From your explanation seems he is trying to shaft everyone in preference to his ...

When you say that you have a charge on the property, what do you mean? Is the loan secured against the property ? If so it cannot be rolled into the IVA.

The ampunt you agree to pay over during the IVA is not the new figure you "owe" -- it is what you agree to try to pay back, at least. As Merlin said -- you still "owe" the full original debt, plus fees and statutory interest. Fees are usually around 15% of the money paid in, plus...

1) The IP should get this creditor to verify their claim but, this isn't always at the start of an IVA. 2) Challenge the information with the IP. 3) The creditors normally expect you to retain a modest vehicle --- an expensive one should be sold, pay for a modest one and pay the balance to the IVA. ...

or should I just give him the cash

Easier to give him the cash. As I say, as long as your total annual income matches that which the IP is expecting to see, it should be OK.

They probably won't notice the extra going out -- but might query the extra payment in at your annual review. The main thing is that your total annual income is what they expect it to be. Be ready to explain if they ask.

You do not want it to be cancelled -- if that happens you will be back to square one with your creditors. You should speak to your IP and ask if the creditors will agree to a full and final based on payments made to date --- basically calling it quits. This way, assuming they agree, the IVA will con...

You say you are not in an IVA -- have you been in one before now ? If so, the money belongs to that, not to you ... so you would be forking out £600 - odd for no return to yourself ! However, in any event, I strongly suspect that you wouldn't see it anyway ! The email could quite possibly not even b...

Most firms get a result on the day (except one -- not yours -- who make a habit of it !). If they come back with changes people usually agree during that phone call, but it would not be unreasonable to ask for time.
