I agree with Lisa -- tax liability up to the end of the tax year in which the IVA commences should be included in the IVA.

Up to three months from the time the termination certificate is issued, which itself could be up to 6 months (usually a lot less) from when the IVA was declared a failure. It will remain on credit reference agency files for the full 6 years from the start.

You need to go back to your solicitor. The IVA provider would have put a restriction (not order) on the property which she should have signed to agree to. Maybe he forged the signature, I don't know. Negotiate with Aperture to see if they will accept that £10k into the IVA in return for them releasi...

The car finance would not (SHOULD not) have been included in the IVA if it was secured on the vehicle. There should have been an allowance made in your expenses to cover the repayments. However, most car finance agreements have an insolvency clause, allowing repossession although many firms do not a...

Silly question alert. Hypothetical. Over the years if you received an ad hoc bonus of say £100 and this wasn't in the 6 months pay the asked to see, therefore they haven't seen the evidence, how would they find out? At the end of the IVA what is usually supplied to them? I want to be prepared becau...

The tax debt for the whole year ended April 2018 will be included as an unsecured creditor in your IVA. You will then need to pay for tax from 6th April 2018. The problem is now you are expected to pay half of next years tax bill (based on current years figures) up front at the end of January and t...

They might approve via email or phone -- but ask for it in writing ( just in case) as well. The only reason it takes so long to approve are internal processes and workload. Some firms have an IP overseeing a few hundred caes andd some have them overseeing thousands !!

It is possible, but not advisable. IF the sale completed before the certificate was issued the proceeds could be drawn into the IVA. Also, as Luluj mentions the restiction on the title would also frighten off any prospective purchasers.

About £28000 at £90 a month via step change OK -- Stepchange do not usually take the spouses earnings into the IVA payment, but I can see why they have done so here. You are right at the bottom end of a viable payment. However, they cannot force the wife to work and by looking you are doing what wa...
