It is so confusing i was reading paperwork and said first10% you can keep and anything over that you go 50/50 but they had it all ..... my head is mashed lol I know it is confusing but you have to keep usual income and overtime apart -- pay the regular £150 from regular pay. Then from the overtime ...

In any event, they will do a final review and probably pick up on the missing overtime then. It will look better if you declare it rather than being caught out.

It is possible that an IP could get the BR petition delayed while you explore an IVA --- the outcome would then depend on the creditor involved accepting the IVA rather than BR if they have the voting power to refuse an IVA. But -- you are leaving things very late so I would be talking to an IP asap.

As I said in your other thread https://www.iva.co.uk/forum/can-i-cancel-my-iva-and-go-with-another-company-t86393#p731563 , depending on the amounts involved, your current IVA might well be under threat anyway unless you convince your IP regarding the neccesity of the new credit. As before -- what c...

I agree and, to make matters worse, the debtor has no avenue of recourse or mediation open to them to arbitrate, should this be needed. I did, early this year, try to raise a petition about this, but the support was, at best, woeful :-(

Each firm has its own procedures, which should be on their website. Otherwise write direct to the new IP, by recorded delivery (post not email) keeping copies. To escalate this to their regulatory body you will need to go here: https://www.gov.uk/complain-about-insolvency-practitioner Smoking does n...

The new firm has to continue with the arrangement as already agreed with the old firm. Your allowances were already agreed and they should not reduce them without good reason. £222 was the maximum for shopping -- they seem to have reduced that to the mid-point guideline, £34 is the maximum guideline...

The terms are, in a nutshell, if you can remortgage or (in post 2014 terms, if they are being used) obtain a secured loan, then you have to do it, regardless of status of the lender. However, there are other limits regarding a remortgage in that the loan repayment cannot be more than 50% of the IVA ...
