What modification are they wanting to remove ? And I would ask them to remove the addition of the power to declare bankruptcy. It is not helpful at this stage. Are you with Payplan ?

Open a seperate bank account with a bank that is not a creditor and either arrange for the funds to go there or transfer it out as soon as it goes in (hopefully Barclays won't freeze the account, but it would not be unheard of). They will be informed as soon as you sign the draft proposal. HMRC are ...

Hello all, what would happen, if say in 2 years time , which would still be within my Original IVA timescale, even though , by this time, I would have received my " Completion Certificate " , I get an unexpected windfall or PPi refund through this " Plevin rule" ? Would ALL of t...

Many thanks for your obviously knowledgeable replies on this matter. What is REALLY annoying then, is the wording of the letter after the FULL AND FINAL OFFER was accepted, I.E. " no further payments into the IVA will be required ". They should say " no more payments by you will be r...

Hi, I'm still without heating, ( my heating system was condemned a few weeks ago) I simply can't find anyone willing to lean / beg or borrow from. I'm not on benefits so not able to receive any help from government. I'm on a iva so unable to achieve finance. Iva break won't help funding issues. All...

It is due to your creditors. I am surprised by this response, given that it states on letter after the creditors meeting, where they accepted the FULL AND FINAL OFFER, " no further payments into the IVA will be required " The refund amount is HIGHER than what is owed to this particular cr...

It is correct that any and all PPI refunds belong to the IVA as this was an asset (albeit unknown) during the course of the arrangement. However, you might be lucky in that Stepchange doesn't usually seem to be concerned with PPI refunds, so thay may just return the funds to you. They do not activel...

The biggy is no IVA in court matters and no default showing on either closed or open accounts. You need to check all three agencies as they often show different things. Personally I think the online sites like Clearscore and Noddle are OK for keeping an eye on things, but you really need a statutor...

As Kallis says -- chat with your provider ... the payments shouldn't become unmanageable and, hopefully, adjustments can be made. How long have you been in the IVA and why are payments getting harder ? Have they been unfairly increased, or have you had a loss in income or increase in essential outgo...

Compensation payouts are not specifically catered for in the IVA framework and so it is down to how the IP wishes to treat it. Some will regard it as a windfall and take it all. However the majority follow the guidance used in BR whereby compensation for pain and suffering is allowed to be retained....

In the circumstances I would think it worth at least discussing a "Full & Final offer based on payments to date". As your IP has pointed out, your creditors would not get anything much in the way of bankruptcy, so would probably not push for it --- this, of course, wouldn't stop you de...
