Yes this is correct. PPI still belongs to the IVA and your creditors. So far we are unaware of what action could or would be taken for non-compliance but, in theory, they could apply to the courts for the IVA to be cancelled. I would engage with Equity in Finance and first ask them to confirm and pr...

You might need to explain to them what an IVA is a...

The Insolvency Service may have archived records or bank statements from around the time might show up a likely payee.

Other than that -- are there any details you can recall which might give us a clue ?

My last payment was January 2016. I have sent 5 emails and not had one response from them . I have called and got cut off . Does this normally happen to people who have finished paying their iva ? Is there anyone on this forum using them and still in contact with them I’m thinking they have closed ...

The solicitor will be dealing with this and will produce an account in due course. These things take time to filter through the system. Once it has gone through the lenders systems it will show as closed right away on credit searches the lenders make, but will not show on the online versions for up ...

IPs do not have the time nor inclination to see how you spend your money. They are only interested in income and the big stuff for agreed expenses (if it changes).

I Have had another letter today saying I have been awarded nearly 3700 in Ppi compensation.... that must be nearly 16k and there is at least 1 more claim outstanding .... amazing how much we all paid! Indeed -- I don't doubt that some of us would not have needed an IVA if the PPI hadn't been lumped...

I would like to agree with Kallis -- but I have always had a nagging feeling that there are records / archives available to the chosen few which go beyond the statutory records. The fuel for this nagging doubt ? : that claims companies going after PPI claim to be able to go back 35 years, without pa...

If I am in an IVA, and have been awarded a loan from student finance to start in September, will that be classed as income, and will some of it have to be committed to the IVA? I will still have the part time job that my original IVA payment is based on. Most IP's will offset this against what it i...

Not if payments have been suspended by prior agreement or if the offer includes a condition that payments made after a given date will be deducted from the lump sum.

Do you still pay every month while you wait for IP to sort F&F? Do they stop taking the card payment? I would put money to one side if so. Depends on if you have agreed a payment break with your IP. If not, it is usual for payments to continue and they will not be deducted from the F&F lump...

He could -- but it depends on the actual terms of your IVA and the creditors instructions.

So is depend of creditors? How they will sort this out? First it will depend on how your IP decides to handle it. He might give you a chance to put things right. If the IVA is terminated your creditors are then free to try to collect the debt any way they think fit. They will add back lost interest...

If they terminate the IVA due to breaches the creditors can apply for bankruptcy, if they think it is worthwhile. They might do it right away (some IVAs have a clause that, in the event of a breach, the IP will petition for bankruptcy behalf of the creditors). or they might take several years. If th...
