Thankyou 'Foggy', so when you mentioned about the equity release has to be over 5K to trigger it, would it have to be 10K altogether with 5K being his share or you mean 5K altogether? He's going to ask them tomorrow to see if he can just take the extension year instead. His share has to be over £5k...

They might not even notice ,,, but, if they do, may require a promise from you not to continue gambling --- they may require you to ban yourself from gambling sites and will examine every statement in detail going forward.

Good luck with the review.

I agree with Keith -- always a good idea to get other advice -- see who you feel more at ease with. I found the process easy enought once I had got to grips with the ins and outs and unsertood exactly what I was signing up for -- the supervisor is a referee of sorts ... YOU have to run the IVA to ke...

This always seems to happen at weekends !!!! The bank have probably, mistakenly, instituted bankruptcy procedures. They should unfreeze the accounts when the error of their ways is made clear to them ... which bank was this ?

Was this the new accounts frozen or the old ones ?

My (ex) wife and I owed around £65k over a dozen creditors and started paying £416 per month, which was accepted by my mix of creditors. Our salaries were broadly similar to yours, but we only had the one child. So, on the face of it, your figures look OK. But, of course, whether the IVA is right fo...

It is possible, but you will then have to release equity towards the end of your IVA, which would be most of the value of the property, being unmortgaged. Is it possible that, as a relative, he could buy it in his name and allow you to live there. I know some relatives are entitled to buy, but it mi...

OK -- first, the equity position will not be decided until about 5 years time .. so there might be equity by then ... but it will have to be more than £5k for his share to trigger the equity release. If the clause is triggered he will have to try to remortgage (which, presumably, you will not agree ...

The terms are that anything unpaid is to be written off and they cannot chase you for any of it. 12 months payments at £211 is only £2.5k, so an offer of twice what they would be getting would get your hand bitten off I would imagine (however creditors and IPs can be funny things!). Don't feel guilt...

If this is in relation to the equity release provisions in his IVA then, as he cannot remortgage, the IVA should merely extend by 12 months at the standard regular payment. I am assuming it is Select who cannot come up with a remortgage deal, so Aperture should accept that. Why do you say he owes £1...

Speak to a couple of firms, such as Lisa, above, Keith White on the number on the top right or a firm like McCambridge Duffy. There are, of course, the so called "Charity" firms, where service can be mixed and the "IVA Factories" like Aperture and Creditfix, as well as numerous small firms around th...

Can I ask, what is the difference between putting a full and final settlement proposal to the creditors himself and entering into a full and final settlement IVA? If the offer is made through an IVA it is legally binding on all creditors if accepted. If he does it himself, as you have learnt, not a...
