Is there anyway I would be able to find out if they voted no for the IVA? Thank you for your response, just having a glimmer of hope is a massive help Those that voted and the way they voted should be listed in the Chairman's Report of the initial meeting. You should have been sent a copy soon afte...

I would imagine the one that rejected also voted against the IVA in the first place and is just having another go! They were out voted then and CF are working to get them out voted again ( all guesswork on my part). By accepting a F&F now, for the full amount they would have got over the next fe...

Payplan is one of the very few firms that take a spousal income into the IVA to form part of the disposable income --- but, having done so they should reflect reductions in one income stream against gains in another and base the payment on any net increase. However they do have tendency to do things...

Have a word with Ryan and / or Shaun, both whole of market brokers with experience in adverse credit applications. As you surmise -- it all depends on how they ask that question and knowing who asks it in which way ! Ryans detaisl can be found here: https://www.iva.co.uk/forum/memberlist.php?mode=vi...

Hopefully you have kept evidence of the agreement to temporarily reduce the amount to be paid, pending the outcome of the variation. I imagine this has ben overlooked by the admin clerk pushing the buttons at their office. Give them a call and ask for the money they have taken without authorisation ...

Modest family gifts are usually OK as long as you can provide evidence of the source if questioned. Chances are it won't be noticed. In the future I would ask that your mum settles anything like this direct or in cash. When you move in with your partner treat it as though you are house sharing and y...

Any PPI recovered after the end of your IVA stil; belongs to your creditors. However, your former IP might deem it uneconomical to reopen old files and re-contact former creditors for distribution of funds, in which case they would allow you to keep the refund. If the refund is beimg made by a forme...

This is a pretty standard clause in these agreements, they are not always acted upon as you will be maintaining the payments. However some companies have been known to terminate agreements in these circumstances. I cannot tell you which way yours will go ... sorry.

The likelihood the issue is to do with their proposed charges. I’m so clueless, what does this mean? Can this be rectified? Charges are queried at nearly every meeting and are usually sorted at the time. CF do tend to try to charge more than most, and might not back down so easily. At the end of th...

The paperwork layout and procedure for the majority of cases has been pre-agreed by creditors for those firms who use Protocol or R3 terms. This was to make the system more uniform and faster to process the applications. It would seem that CF are trying to depart from the "norm" and set up...
