Yes, it belongs to the creditors as an asset of the IVA regardless of source and, yes, that is forever (albeit the claims process is ending soon anyway ) .

After all is done and dusted the IVA is closed. However the "account" can remain open so that future PPI can still be processed and distributed to creditors. Also, in the event of fraud or some other serious anomoly being discovered the IVA can, in extreme cases, be referred to the court t...

Topic: £500 Credit Limit in an IVA
Replies: 3

It is generally taken to mean you cannot owe more than £500 over all lenders at any one time, although an IP would be free to interpret it the other way if he felt that was what it means ! It could also be used to encompass ( and possibly used up by) monthly paid utilities and car insurance, so you ...

Oh wow thank you. Interestingly the supervisor emailed me today to say it's with the variations team, no date as to how long they will take to draw up the paperwork (it's been over a month now) and that then they have to give 28 days notice to the creditors Hmm Yes, they do have to give notice to t...

As for selling online, she is allowed to sell her own surplus belongings but not as a business. There would be nothing stopping her from helping her friend to use eBay effectively. If she declared it as her friend's and the paper trail does not show a link from her friend's account to hers, then wo...

The idea is that you do not have much, if anything left over at the end of each month! As long as your allowances cover the essentials, the rest goes to the IVA. If you feel your allowances are wrong you should get them looked at. Yes, in an emergency, your IP has the discretion to agree a payment b...

A regular gift could well be looked at as an income and the ISA might be regarded as an asset. Have you mentioned the ISA to your IP ? What sort of sums are we talking about ? If modest it would be better that you made the deposits from savings on housekeeping and dad slipped you a bit of cash ---- ...

I had one with the Yorkshire Building Society (not Yorkshire Bank) opened during my IVA with no problem. Swinton, at the time, also said they would be happy to open one.

Thank you all for the response and advice. I believe the Iva company is treating it as PPI and having been out of this saga for 15 months I can’t be bothered to chase it or waste my time anymore they can have it. I have rebuilt my life and am living it now without the IVA and am just glad it’s over...

I would imagine everything would have to be in their name --- otherwise you are acquiring an asset that the creditors might then want to see realised to pay towards your debts. Also your ability to run a business will be hampered by your lack of credit worthiness and you would have to deal with supp...

Great post and very interesting. Good to see that Aperture came to the rescue. I am left wondering why DFD added a year to the term (which, thanks to Aperture, you don't have to serve).

PPI was never specifically mentioned, neither are refunded charges. However, they are both considered after acquired assets and are grabbed under those clauses, whether you signed an assignment or not. Although most IPs are not under the remit of the FCA, their firms might be, so linking that to the...

Apologies for the delay ... I had to ask a friend ! It will depend upon which terms are used: In R3 cases the requirement to convene the meeting within 21 days is in Part X section 60(2) ..... "60(2)[Power to requisition a meeting] If requested in writing by the Debtor, or by Creditors with not...
