I know in an IVA the potential debt can be taken into account, but am unsure if the same applies in DRO / BR. Hopefully someone more knowledgeable will come along and respond more usefully.

As above, yes you can, indeed. Have a chat with a couple of providers to compare. You do need to be comfortable working with them and they do all operate slightly differently within the broader framework of regulations.

After the IVA is concluded and you have your completion certificate it is up to you what money you give your sister !

Your creditors are expecting around £8.6k more, so I would think an offer around £6k would be looked at seriously.

Good luck.

No I haven’t said anything as I wasn’t aware that I had to, but now you’ve said it, it does make sense that you would deal with it that way! I will see what they say at my review, probably have to stump up extra per month! But this is one of the reasons I wanted to try and get out of the Iva before...

I assume the question of equity has been addressed in the IVA and you have done the extra 12 months ? Depending on who you are with it could take up to 6 months to get that certificate and a further month to get the restriction lifted at Land Registry -- and chase them on this as the IP's sometimes ...

Your IP should apply to the court to have these deductions stopped, assuming the debts are now in the IVA. How are they fobbimg you off ? What are they saying ?

The total debt was about £43k of which I have paid £3300 into the IVA. At my annual review last year I had to send payslips off ( hadn’t been in IVA a full year to need my P60) then I just had to agree that my bills were the same, no bank statements etc were needed so I’m hoping this year will be t...

Hi -- Given the circumstances and a high chance that you will be unable to pay the IVA in the future, this seems like a good plan. Get agreement first, before selling the car. If you make this offer and it is accepted you will be released from the IVA soon after making the payment. You will still ne...

Hi Tomasz. Your friends IP will need to check the funds and will ask for bank statements and, possibly, proof of ID from you. This does not mean that you are in th IVA system and there will be no connection between you and your friend's IVA.

If you have that amount of cash available you need to use it to pay off your debts. You will not be permitted to buy a house.

Hi. Your creditors are expecting at least another £6.5k in payments from you, so I think an offer of £2k would be a little light. I would have thought that nearer £4k would be the minimum, but, as I always mention, I have seen low offers accepted as well a high ones refused. Regarding the new living...

Your IVA concerns your debts and the payment is based on your income. An increase in your partner's income will slightly increase his share of household expenses -- if CF even want to know -- so your IVA payment might go up by a few quid, but not much. It is not his place to pay your debts, so his ...
