You need a 75% yes vote from those that do vote at the meeting. The percentage is based on the debt amount. So, if any one voter holds more than 25% of the debt and votes no, the IVA will not go through.

Re moving. You cannot borrow from relatives -- this would be a new debt and no credit is allowed over £500 without the IP's permission. You would not be allowed to an allowance to repay in any event. You might be allowed a payment break to cover the costs. You would have to negotiate on how the expe...

You can offer to sell the house for the purposes of a F&F, only doing so if the offer is accepted. The amount offered will be based on the remaining payments, plus 12 (for equity release), which can be rounded down a little. If you simply sell up and divide the proceeds between yourself and ex t...

Paying all the debt is a bit of an overkill and, frankly a waste of hard saved pension. Rather than that why not offer a full and final based on the amount of remaining payments ? As home owners your 6 year IVA will probably have an extra year tacked on, so count those payments in as well. Do not dr...

Thank you Lisa, yeh I had heard it can take a mth to set up, only reason I’m waiting a mth is that my last loan to clear my partners credit card which was lent to my to buy a car, didn’t think it would be appropriate to start straight away as I didn’t want to look cheeky. Also I won a ppi claim but...

In the circumstances the offer looks a good one, considering, if the IVA fails they will get nothing more ! In the immediate meantime, ask the IP to agree a payment break, so you need not make any more payments while waiting. I doubt that the creditors would get anything out of bankruptcy, so that ...

Stepchange and Payplan are, in part, funded by "donations" from creditors and are often the firms "pushed" by them when borrowers get into trouble. Personally I think it borders on miss-selling when pushing a product (firm) on a vulnerable individual. But,hey, many lenders have a...

I can't see any reason why they would want a second hand chair back. As regards your wanting to take a month break before starting an IVA just so you are aware it will take about that long to produce the proposals and call the meeting of creditors to vote on them. Thank you Lisa, yeh I had heard it...

I assume that you are in interlocking IVA's ..... when myself and my then wife were in a pair of interlocking IVA's the base income was the two seperate incomes added together and any overtime (whichever one of us earned it) was the amount over the combined income. You need to speak to your IP regar...

All of your qualifying debts would be covered by the DRO, so there would be no need for a DMP to run alongside it.

If Beesly are telling you the IVA assets are held on trust and that is why the restriction is still on there you should revert back to them. I can recommend a specialist insolvency solicitor, which you might need to help you with this but your starting point is Beesly if the restriction is theirs -...
