I have had this arguement with the Insolvency Service and them denying any removal from the register before three months, whilst I was telling them of instances happening while we were discussing the matter --- in the end they simply stopped responding to me! I do not think it is legislation but rat...

As Luluj says, assuming your husband conducts the IVA correctly, the house will not be lost. He will, however, need to investigate releasing his sghare of the equity towards the end of the IVA. I am afraid that, if you have transferred the house into joint names then he legally owns a share.

Sorry, me again! Just been doing some nosing around online and have seen people saying they are paying as little as 8p of the £1 to their creditors, per my proposal, should it be accepted I would be returning 55p of the £1. Considering a lot of what I have read, this seems to be a great offer right...

I hope the dream of a Fiat 500 becomes a reality soon. Nice car and very chic, not that it would suit a past middle age man with his "Christmas podge" still visible  :D

Thanks foggy. So each month that they delay and I continue paying extra into the 6th year they still get the agreed equity release money too?!! surely that encourages them to keep delaying! They might get an extra 3-6 months payments AND the equity release!!! I might as well just pay the extension ...

I am sorry, but I can only echo Merlin's advice. Your guarantor should also seek advice as Amigo will look to him or her for repayment in the event that you default.

You will breach the terms once you miss three payments and, unfortunately, without an agreed payment break, payments are still due whilst awaiting the outcome of a F&F. I am curious to know why it is that CF cases always seem to be adjourned, both at initial meetings and variations -- what are t...

Getting the debtor to do this seems to be the new thing with several insolvency firms, although technically it shouldn't be needed as the "system" should take care of it. However, it is advisable, as Luluj says, to check the basics -- are the default dates all correct (indeed, are all the ...

Welcome. I think the majority of us felt awkward at missing payments just prior to the creditors meeting, but many of us did it anyway to create a small contingency fund. It will not affect the voting and, if the IVA is accepted, would be money down the drain. We get very few refusals these days (al...

I would say that if the money is used for it's intended purpose -- ie repair & replacement, it is not a windfall. However, you IP might have other ideas and you should run it past him or her first.

I am currently in an IVA and selling my house can you please tell me how much I have to pay back, will it be what I owe on the IVA or the original debt? You will have to pay whatever amount takes you up to covering the full original debt, plus fees and possible statutory interest. Alternatively you...
