The PPI belongs to your creditors unless, as Kallis mentions, it covers the full original debt, plus fees and possible statutory interest, in which case any surplus will be returned to you.

I am afraid that if you sell the house now your creditors are entitled to 85% of the equity as you are disposing of an asset. You do not merely "owe" the remaining payments, but still actually owe the full original debt, plus fees and possible statutory interest. Unfortunately you have put...

I finish paying my iva in July but I'm struggling this month and need a hundred pound to get through the month. There is no one I can borrow off. I've never missed a payment. Would getting a pay day loan now affect my iva/ credit? Getting a payday loan would be inadvisable. Unless you have the usua...

It will depend on the level of debt and the value of the home, as well as how your own creditors view it. But certainly worth a chat with a few firms for specific advice. Owning a home in itself is not a bar to an IVA, but, as usual, it all boils down to figures.

I foolishly took out some payday loans during my IVA and am now considering complaining about the companies involved, I just wanted to check whether it might cause me problems if it came to light I took them out.

Personally I would let sleeping dogs lie and draw a line under it.

Yes, it belongs to the creditors as an asset of the IVA regardless of source and, yes, that is forever (albeit the claims process is ending soon anyway ) .

After all is done and dusted the IVA is closed. However the "account" can remain open so that future PPI can still be processed and distributed to creditors. Also, in the event of fraud or some other serious anomoly being discovered the IVA can, in extreme cases, be referred to the court t...

It is generally taken to mean you cannot owe more than £500 over all lenders at any one time, although an IP would be free to interpret it the other way if he felt that was what it means ! It could also be used to encompass ( and possibly used up by) monthly paid utilities and car insurance, so you ...

Oh wow thank you. Interestingly the supervisor emailed me today to say it's with the variations team, no date as to how long they will take to draw up the paperwork (it's been over a month now) and that then they have to give 28 days notice to the creditors Hmm Yes, they do have to give notice to t...

As for selling online, she is allowed to sell her own surplus belongings but not as a business. There would be nothing stopping her from helping her friend to use eBay effectively. If she declared it as her friend's and the paper trail does not show a link from her friend's account to hers, then wo...

The idea is that you do not have much, if anything left over at the end of each month! As long as your allowances cover the essentials, the rest goes to the IVA. If you feel your allowances are wrong you should get them looked at. Yes, in an emergency, your IP has the discretion to agree a payment b...

A regular gift could well be looked at as an income and the ISA might be regarded as an asset. Have you mentioned the ISA to your IP ? What sort of sums are we talking about ? If modest it would be better that you made the deposits from savings on housekeeping and dad slipped you a bit of cash ---- ...
