Many people in an IVA get student finance with the agreement of the IP. The problem here is, possibly, not the finance itself, but the fact that you haven't discussed it or got the permission of your IP. There is always the chance that they will notice at some point, so maybe it would be an idea to ...

Rather than re-opening the arrangement, it could be set aside (invalidated) by the courts if the IP is so minded to apply and the court minded to agree. There are other sanctions like fraud charges. Again, if the IP is so minded.

They have to submit the report to creditors within 2 months of the anniversary date, so they do have a good amount of leeway. If you are worried, give them a call.

£30k is high for a DMP, but, of course, it will also depend upon the anticipated repayment level. But, more to the point, creditors often like to see a gambling free period and a short term DMP is one way of reducing the stress of trying to make impossible repayments during this period.

What are these "Admin Charges" ? If they are fees, they can obnly charge what was agreed in the proposal or Chairman's Report (Chairman's Report overrides the proposal), unless you have agreed to a variation. They are not added on to the payments but are part of them already. Do also read ...

Hi. The process is to make a formal complaint to your IP and this can then be followed up by a complaint to their regulatory body, if no joy. Complaints to regulators are made via the government gateway at: https://www.gov.uk/complain-about-insolvency-practitioner A Freeman Jones representative ofte...

You would need to seek, and gain, the approval of your IP and I doubt this would be forthcoming. In any event, even with approval, it is highly unlikely that you will be granted finance as you will fail any credit check.

Insurance payments are not defined in IVA terms and conditions, but IP's tend to follow the practice as in bankruptcy. So, how your own IP will treat the compensation is down to them. Those that follow the BR procedures (as most do) will allow you to retain compensation for "Pain and Suffering&...

So in short, I think I'll ignore the message from them. A PPI was paid into the IVA and there isn't anymore to get as far as I'm concerned. They contacted me just after I received the completion certificate on this, which wasn't fruitful for them then, so this is outright abuse of my contact detail...

PPI isn't normally payable into a DMP -- so I am guessing they are trying to generate leads for a second income string or a third party claims company. By your reference to beig on the public register I assume you mean an IVA. If this is the case the PPI is payable to the IVA and they are all scrabb...

You will fail the required credit check. There should be no need for one if your expenses have been correctly calculated and your spending habits adjusted to suit. As said most arrangements do allow for credit up to £500, but this is usually taken up with things like electricity and gas on credit me...

I would say to keep it --- it is not a windfall, it is money you have already paid out being returned. Also, if it were to be considered a windfall, assuming you have the usual clauses, it is less than the trigger amount of £500.
