Thanks to both of you for your replies. I suspected that protocol would akkow for retention, especially "However, it does not belong to the one former creditor, but to all of them on a pro-rata basis." You're 100% correct on having to revisit the past - not worth it. Thanks for clarifying.

Hi - thanks in advance for your thoughts / answers about this. I was a victim of the property crash and I subsequently lost my rental properties, my health and you could say my mind too - the banks were ferocious. I had a Lump Sum IVA approved at a Creditors' Meeting in September 2012. I paid the lu...

Just started to follow this thread but I'm not sure I understand. If someone is 56 and their pension can be drawn down (ie. it has a drawdown facility) - let's assume they have a fairly sizeable pension pot - and let's assume they could satisfy creditors with a "lump sum IVA" proposal, will the cred...

Michael,

That's great news. I thought I'd invented something creative, but alas, no :)

Many thanks for such a detailed answer.

Just thinking out loud at the moment. To my knowledge, if a lump sum IVA is accepted by creditors, it usually takes around 12 months to be discharged. If I have a wealthy relative who may leave me some money/property in his will...would this be snapped up by my creditors if my relative was to pass d...

For lump sum IVAs, an IP will sometimes request clear funds be held in their account and they will send you a document which states that in the event of the lump sum IVA being declined, full funds will be returned to you (or the 3rd party who supplied the funds). This shows that it is clearly your i...

Complicated answer and a long one to explain here but be assured it's all above board otherwise I wouldn't ask the question here. Thinking in advance...as part of any lump sum IVA proposal I'd make, in the event it is accepted, I'd undertake to voluntarily surrender my Buy-to-let properties. Obvious...

If a lump sum IVA is approved - then what?

Does the supervisor require me to attend any meetings following acceptance of a lump sum IVA. Will the supervisor want to check my accounts for the last x months/years etc?

Thanks in advance
