As you hold such a high percentage of his debt the IVA can't go ahead unless you agree but that doesn't stop him going bankrupt where you may get a much lower payout.

IVA trumps CCJ and Bankruptcy trumps both.

Not wanting to rain on your parade OP but we received a letter from Payplan when my wife's IVA finished last year. It said we had fullfilled our obligations etc, etc. but we still waited until the beginning of this month for the actual completion certificate.

If the sale is already agreed wouldn't any creditor expect all the equity to be paid into the IVA?

Up to the max owed of course.

If you are making a profit from the business then it IS worth something and this looks as if you want to put it in your wife's name, continue working at it and have those profits go to her instead of your creditors.

I imagine you would have to prove it wasn't you driving. As long as we are talking about private parking company parasites, which we must be if debt collectors are involved, then no you don't. You just need to inform them. They may squal and wring their hands saying you should have told them before...

The parking "fine" is easy, simply give your ex's details to the parking company (not the debt collectors, they should be ignored) and that is it. Not your problem anymore.

To answer you question OP we still think as if the payment for my wife's IVA is still going to go out and our last payment was September. It still comes as a nice surprise.
