Hi

Have you explored all other options already or have you already determined that an IVA is the best option?

It's sensible to show around and ultimately speak to an IP that you feel comfortable with.

Make sure they are licensed.

Your Company cannot be included in an IVA - were you a sole trader? Do you mean your business debts were included in the IVA?

I would suspect the future lease payments would have fallen into the IVA as a contingent liability at the time - you should speak to your IP about it.

Check your terms as regards the equity clauses. Assuming the 'standard' clauses apply then get a valuaiton and establish if you have more than the minimum amount of equity for the clauses to kick in. He doesn't have the legal responsibility of paying his wife's contributions/debts but unless this can be sorted he is at risk of losing his home if his wife's creditors cannot be dealt with, so he does need to rake responsibility.

Why don't you calculate the 'extra' contributions from your bonuses/overtime etc first (assuming you have the 10:50:50 rule) so you know what to expect?

At what stage are you with the IVA?

Where are the funds coming from to buy it - If from savings then I presume the cash has already been disclosed as an asset in your proposals (if drafted)?

Can you clarify a little more about the Court order you are referring to?

Do you mean the shares were omitted from your proposals?

Even if they were this is still an asset of your IVA - it was your duty to ensure they were disclosed in the IVA proposals.
