The CC is sent to the Insolvency register.

Your creditors are also told that the IVA has completed and that they should update their records accordingly, but unfortunately many don't and you have to do a bit of leg work to tidy up your credit rating yourself..

I would recommend you instruct your Solicitors to try and fight the interim order and see if you get get a final one.

I can recommend a good insolvency Solicitor.

That is outrageous behavior from an IP who is supposed to be impartial and professional and is duty bound to act in accordance with an ethical code. You could consider asking a complaint. Sorry I had assumed your IVA was closed, but assuming it isn't then yes your IVA estate will likely be entitled to these funds and you have a duty to cooperate.

Unfortunately you will have to pay the windfall into the IVA unless and until the total debts, costs and interest have been paid.

You might be able to ask creditors to waive their right to interest, assuming it was chargeable under your terms.

When you say that you have a charge on the property, what do you mean? Is the loan secured against the property ? If so it cannot be rolled into the IVA. I have an interim charging order on the property he owns with his wife. It has not been made final however. The judge was due to look at the pape...

You need 75% in value of creditors voting to vote in favour.

Your IP should have explained all of this to you already and it must have been in the paperwork you have agree to...

The figure should already be detailed in the proposal you have signed.

I am concerned you do not know the figure if you have properly read and understood the proposals and appendices.

What is the comparison with Bankruptcy?

This is what you need to be looking at because if the IVA is rejected she may well go Bankrupt and you will rank alongside her other unsecured creditors.

Where is says 8p/£ for IVA what does it estimate creditors would get back in Bankruptcy if anything?

75% of creditors in value who vote, have to vote in favour for the IVA to be approved.

You have more than 25% of the votes so you therefore have all of the power because if you reject it they can't get 75% approval.

You can therefore approve, reject or propose modifications.
