I would still recommend you get the variation in place first.

How much are your contributions?
How long do you have left in your IVA?
How much debt did you have originally?
How much is your estimated share of net equity?

If you sell it without a variation approved by creditors then you will have to pay over all of your share of equity unless and until the total debts, costs and u...

A deed of assignment usually assigns (transfers) something from one party to another.

What you need to look for is if you had Payment Protection Insurance.

Sorry for the typo in my post above - I meant £5k not £35k minimum equity.

As you have over £5k equity then (depending on your terms) It would seem that the year extension may apply to you - watch my video here -

I'm really surprised you were able to get commercial credit post IVA. Are you sure it's an IVA you are in?

You will have breached any IVA terms as regards credit and should come clean to your IP.

Have you had a recent valuation and redemption figure from any secured creditors to establish whether your wife's share of equity is above the standard minimum (35k)?

If you can challenge Creditfox's calculation of equity the extension may not apply.

What are your IVA terms about the equity?

My quick video here might help you understand your options.

Also, recommend you verify the equity level in your property to see if the standard clause applies.

Check what was in the original letters when your Nominee/IP wrote to you about why you have chosen the IVA over other options - the alternatives should have been explained in the letter and the reasons they have been discounted.
