So £80 x 29 = £2,320 or worst case with changes to income say £280 (less any additional expenses for travel etc) x 29 = £8,120.

Do you own a property? If so have you allowed for the potential 12 month extension?

Apologies I didn't realise you said two other creditors voted yes.

You will need 75% in value of creditor voting, in favour, for the F&F to be approved.

Surely HMRC an tell the IP how they voted....

They usually vote by fax so if it is late then the IP should mark it as invalid...

If no creditors voted except for HMRC then HMRC's vote will be 100% of the votes...

...if anything you could instead offer a full and final to the creditors, equal to the payments they would have received had the IVA continued successfully to full term, from the proceeds of the voluntary sale of the house.

That way you might get something back.

I doubt you would make any profit - your share of equity will either be held on trust for the IVA creditors OR be swept up in the Bankruptcy. The costs in Bankruptcy are extremely high. £6k of taxes alone. How much equity do you have, what are your total creditors and what have you paid into your IV...

I would need to know more information but on the face of it I would seriously consider the Bankruptcy route - the deposit would not be known as the property is in your name and in any event I can't see she has any interest in the property if you can prove that the deposit was a gift.

Given the high level of equity at risk and sums involved I seriously recommend you speak to a specialist insolvency solicitor to help you asap. I can recommend one if needed.

You could ask your IP for permission to get this credit and confirm that the payment of £100 a month will be deemed an acceptable expense that forms part of your I&E and explain you need it for a new job increasing the amount payable into the IVA by c£100. As regards any offer bear in mind if th...
