I agree with Foggy both you and creditors agreed to the formula used in your proposals. Challenge this with them.

Worst case scenario it may even be worth instructing solicitors to fight this to save you the extra year of payments. Hopefully that won't be necessary.

He doesn't have to give them evidence of his income and expenditure but if your husband earns less than you and you can prove it then this may support a position of you paying more than 50% share of joint expenses and therefore have less money for contributions into your IVA. You will be unlikely to remortgage with the IVA in place so the most likely scenario (if you don't go down the other route of 3rd party lump sum or secured loan) is a 12 months extension of your IVA.

If you fail your IVA the IP will take their costs out of the monies you have paid in to date. There may not be anything left for the creditors. You will then be back to square one and will have to pay your total debts plus interest and at risk of debt recovery proceedings. How much are you total cre...

I agree with Foggy's advice and am interested to know if you declared this extra income to your IP - has it come from your share of the 10/50/50 rule? (i.e did you pay some of your overtime/bonuses etc over to the IP and they agreed you could keep some?)

Sorry to repeat myself but can you confirm how much equity there is in your property?

If you can show it is less than £10k then the extension may not be applicable and you may be able to complete your IVA now instead of paying another 12 months...

Cobby if you are in an interlocking IVA then the total joint equity could be less than £10k (5k) each for the equity clause to kick in.

How much equity is there and is this based on a valuaiton?

If so then it's likely the 12 month extension will apply and you have 12 more payments to make... Its a joint mortgage and joint iva, Freeman Jones use a certain site apparently they use f...
